16. Arbitration and Class Action Waiver

Any dispute arising from these Terms or the Service shall be resolved exclusively by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. Judgment on the award may be entered in any court with jurisdiction. Both parties waive rights to jury trial and to participate in class or representative actions.

PineTales LLC shall not be liable for failure or delay in performance due to causes beyond its reasonable control, including natural disasters, acts of government, pandemics, or internet failures.

18. Severability and Waiver

If any provision is found invalid or unenforceable, the remainder shall remain in effect. Failure to enforce any right is not a waiver.

19. Termination

We may suspend or terminate your access for violations of these Terms or for any reason at our discretion. Upon termination, your right to use the Service ceases immediately.

20. Entire Agreement

These Terms, including all referenced policies, constitute the entire agreement between you and PineTales LLC regarding the Service and supersede prior communications.
